1. Overview

AMG63.com, a brand of SCHUCHARDT N.S.S. SECURITY – Nicky Schuchardt, operates a community via the domain www.AMG63.com. The purpose of the community is to create an exclusive network for motorsport enthusiasts, companies, photographers, and cooperation partners. Registered users can connect with each other and communicate.

AMG63.com, a brand of SCHUCHARDT N.S.S. SECURITY – Nicky Schuchardt, provides access and use of the community based on these Terms of Use. These govern the relationship between AMG63.com as the operator of www.AMG63.com and the registering user, as well as the relationships among users of www.AMG63.com. The Terms apply to all content, features, and other services provided by www.AMG63.com.

Through registration, users become identifiable to one another and are protected against misuse. Eligible are legally natural persons. In addition, companies may also use www.AMG63.com.

a) Agreement to GTC upon Registration
In order to use www.AMG63.com, registration is required. By registering, you agree to these Terms of Use in full and enter into a usage contract with AMG63.com, a brand of SCHUCHARDT N.S.S. SECURITY – Nicky Schuchardt.

If you do not agree with our terms, we cannot provide you access to www.AMG63.com.

b) Only One Membership per Person
Each user may register only once for www.AMG63.com and confirms upon registration that they are not already a member.

If a user has previously been a member and terminated their membership, they may re-register unless they violated the Terms of Use under their previous account.

c) No Guarantee for Actual Identity of Users
Identifying individuals on the internet is only possible to a limited extent. Therefore, www.AMG63.com cannot guarantee that the contact details provided upon registration are accurate. The operator cannot warrant the true identity of any user; users must verify the identity of other users themselves.

2. Account Types

www.AMG63.com offers different account types depending on your needs.

2.1. Free Registration and Trial Contract

a) Registration Process
The free registration process begins with a registration form. Users must provide complete and accurate information unless the field is marked as optional.

Upon completion of registration, a free trial contract is established between you as a user and AMG63.com, a brand of SCHUCHARDT N.S.S. SECURITY – Nicky Schuchardt, unless the operator rejects the registration.

After the trial phase ends, AMG63.com, a brand of SCHUCHARDT N.S.S. SECURITY – Nicky Schuchardt, will provide an offer to continue membership for a moderate annual fee, structured according to cooperation/advertising services, etc.

If you do not accept the extension or fail to pay the annual fee despite invoicing and reminders, your account access will be deactivated.

b) Service Scope (Summary)

• Internal marketplace for offers within the network

• Personal profile with various options

• Personal map entry in the overview map

• Own image and video galleries

• Plan and present events

• Forum for exchange/communication

• Internal chat (single or group)

• Search and display options for various community content

• Special offers and more…

3. Usage

Accounts must only be used in the spirit of the AMG63.com community. Using user data for other purposes is prohibited. Likewise, it is forbidden to use AMG63.com or its accessible content/brand identifiers for commercial purposes without authorization.

Content accessible through www.AMG63.com may not be copied, distributed, or otherwise made publicly available without the rights holder’s consent, except as permitted by law.

4. Copyright and Trademark Rights

a) Content of www.AMG63.com
AMG63.com strives to respect copyright in all publications, to use self-created or commissioned content, or to rely on license-free content.

All trademarks and brand names mentioned within www.AMG63.com, including those protected by third parties, are subject to applicable trademark law and the ownership rights of their respective owners. Mentioning them does not imply they are not protected.

Copyright for published, self-created content remains solely with AMG63.com, a brand of SCHUCHARDT N.S.S. SECURITY – Nicky Schuchardt. Any reproduction or use of such objects in other electronic or printed publications requires prior written consent.

b) User-Generated Content
Users must own the rights to any content they upload (see also Section 5b).

AMG63.com may store user content for community operation. If a user objects, such data will be deleted. Upon membership termination, the account and personal data will be permanently deleted unless required by law to be retained (e.g., contractual records). If AMG63.com wishes to use user content in other media for promotional purposes, prior consent will be obtained.

5. User Obligations

a) Data Confidentiality
AMG63.com protects user data in compliance with data protection laws. Users should carefully consider what data they share online:

• Handle login credentials securely and never share them with third parties. AMG63.com staff will never ask for passwords.

• Inform AMG63.com immediately if you suspect a third party has gained access.

• Update login data promptly in your account if changes occur.

b) Content Responsibility

1. Legality of Content
   Users are responsible for ensuring their content is lawful and does not violate laws or third-party rights. Content violating laws, third-party rights, or public decency is prohibited.

2. File Usage Rights
   Before uploading, users must ensure they hold the exclusive/valid rights to use the file. By uploading, users grant AMG63.com the right to use the file within the platform.

Prohibited are uploads containing violence, sexual, discriminatory, offensive, racist, defamatory, or otherwise unlawful content.

Files featuring other identifiable individuals may only be uploaded with their consent, which can be revoked at any time.

Users may remove or replace their uploaded files at any time.

c) Prohibition of Harmful/Disruptive Interference
Disruptive activities (e.g., spam, system overload, hacking) are prohibited. Any electronic attacks on AMG63.com or its users are forbidden.

6. Sanctions for Violations

Violating these Terms may result in sanctions, including warnings, partial or full content deletion, temporary suspension, or permanent ban. Permanently banned users may not re-register.

7. Termination of Contract

Users may terminate their membership anytime with three months’ notice to year-end.

a) Termination by AMG63.com

1. Ordinary termination – with two weeks’ notice to month-end.

2. Extraordinary termination – possible in cases of severe violations.

b) Consequences
After termination, the account and all user content/data will be permanently deleted (unless retention is legally required).

8. Liability

a) No Monitoring Obligation
AMG63.com is not obliged to monitor transmitted or stored information (§§ 7 ff. TMG). Illegal content will be removed upon discovery.

b) Indemnification
Users indemnify AMG63.com against third-party claims resulting from content they upload. Users must cover legal costs and cooperate fully in defending against such claims.

c) Unlimited Liability
For damages arising from intent, gross negligence, or injury to life/body/health.

d) Limited Liability
For other damages caused by negligence of AMG63.com staff or agents.

e) Disclaimer

• No liability for minor negligence, outdated/incorrect information, or user activities.

• No liability for linked external sites or user-posted links.

• No liability for unauthorized data access (e.g., hackers) unless caused by AMG63.com’s gross negligence.

• No guarantee of uninterrupted availability of www.AMG63.com.

9. Data Protection

Our Privacy Policy applies (see section “Data Protection”).

10. Final Provisions

a) Amendments to Terms
Changes will be sent via email. If not objected to within six weeks, they are deemed accepted.

b) Use of Third Parties
AMG63.com may employ third parties to fulfill obligations.

c) Governing Law
German law applies. The place of jurisdiction is Merseburg, Germany.
